1. About us

These Terms and Conditions (“Terms”) govern:

(a) your use of our website, olivegrovecare.co.uk (the “Website”); and (b) at a general level, the basis on which Olive Grove Care (“we”, “us”, “our”) provides information about, and enquiries relating to, our home care services.

Important note: These Terms cover use of our Website only. The actual provision of care services — including price, scope, cancellation rights and liability for care delivery — is governed by a separate written Service User Agreement / Care Contract, which is provided to and signed by each client (or their representative) before care begins. If there is any conflict between these Website Terms and a signed Service User Agreement, the Service User Agreement takes priority in relation to care services.

2. Use of this website

By using our Website, you agree to these Terms. If you do not agree, please do not use the Website.

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, any third party.

You must not:

  • use the Website in any way that causes, or is likely to cause, damage to the Website or impairment of its availability;
  • attempt to gain unauthorised access to the Website, the server on which it is hosted, or any server, computer or database connected to it;
  • use the Website to transmit or send unsolicited commercial communications;
  • copy, reproduce, republish or redistribute content from the Website without our prior written consent, except as permitted for your own personal, non-commercial use.

3. Enquiries and information on this site

Content on the Website — including descriptions of our services, staff, pricing indications, blog posts and FAQs — is provided for general information only. It does not constitute:

  • medical, clinical or care advice specific to your circumstances;
  • a contractual offer to provide services on any particular terms; or
  • a guarantee of availability of a particular carer, service, or care package.

Submitting an enquiry form, calling us, or subscribing to our newsletter does not, by itself, create a contract between you and us. A contract for care services is only formed once we have carried out an assessment and both parties have signed a Service User Agreement.

We take reasonable care to ensure information on the Website is accurate and up to date, but we do not guarantee this, and we may update or correct content at any time without notice.

4. Care services (summary)

Where you engage us to provide home care services, the following will generally apply, as set out in full in your Service User Agreement:

  • We will carry out a care needs assessment before agreeing a personalised care plan.
  • Services are delivered by carers employed or engaged by us, subject to our recruitment, vetting (including DBS checks) and training processes.
  • Fees, payment terms, and cancellation/notice periods are set out in your Service User Agreement and any accompanying schedule of fees.
  • We are regulated by the Care Quality Commission (CQC) and deliver care in accordance with applicable CQC standards and relevant legislation, including the Health and Social Care Act 2008 and the Care Act 2014.
  • Either party may terminate the care arrangement in accordance with the notice period set out in the Service User Agreement, except in cases of serious breach, risk to safety, or as otherwise permitted by law.

Nothing in these Website Terms is intended to limit any statutory rights you have as a consumer, including rights under the Consumer Rights Act 2015 where applicable to a care services contract.

5. Fees and insurance

Where indicative pricing appears on the Website, this is provided for general guidance only and is not binding. Actual fees for care services will be confirmed in writing before services begin. Where care is funded in whole or part through insurance or local authority funding, it remains your responsibility to check the terms of that funding arrangement; we will assist where reasonably possible but cannot guarantee cover or approval by a third-party funder.

6. Intellectual property

All content on the Website (including text, graphics, logos, and images) is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may view and print pages from the Website for your own personal, non-commercial use, but must not otherwise reproduce or exploit any content without our permission.

7. Third-party links

The Website may contain links to third-party websites (for example, social media platforms). We are not responsible for the content, accuracy or practices of any third-party website, and including a link does not imply our endorsement of it.

8. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Subject to the above, to the fullest extent permitted by law:

  • we are not liable for any loss or damage arising from your use of, or inability to use, the Website, or from reliance on any content on the Website;
  • we are not liable for any indirect or consequential loss.

Liability arising from the actual delivery of care services is governed by the Service User Agreement and applicable law, and is not limited or excluded by these Website Terms.

9. Privacy

Our use of personal data collected through the Website and in connection with our services is set out in our separate Privacy Policy, which forms part of these Terms by reference.

10. Changes to these terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or how the Website operates. The “last updated” date above shows when they were last revised. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of England and Wales, and any disputes relating to them will be subject to the exclusive jurisdiction of the courts of England and Wales.
